Automation, marketing, reputation management, SEO, advertising, communication, and technology services involve factors outside Revenue Regear’s control.

Lead volume
Conversion rates
Search rankings
Review volume
Review ratings
Message delivery
Appointment volume
Customer responses
Platform availability
Specific financial results
Any examples, estimates, projections, or past results are illustrative and do not guarantee future performance.

5. Service Agreements
Paid services may be governed by a separate proposal, order form, statement of work, subscription agreement, or client agreement. If a separate signed agreement conflicts with these website Terms, the signed agreement controls for that service.

6. Acceptable Use
You may not use the website or Revenue Regear services to:
Violate any law or regulation
Send unlawful, deceptive, abusive, threatening, or harassing communications
Send messages without required consent
Use purchased, rented, scraped, or improperly shared contact lists
Impersonate another person or business

7. Client Messaging Responsibilities
Clients using Revenue Regear technology or services remain responsible for:
The legality and accuracy of their contact data
Obtaining and documenting legally sufficient consent
Providing required notices and disclosures
Honoring opt-outs
Maintaining accurate brand and campaign registration
Complying with TCPA, state law, carrier rules, platform policies, and industry standards
Ensuring that messages match the registered brand and campaign
Avoiding prohibited content and unlawful lead-generation practices
Revenue Regear may suspend messaging or services when it reasonably believes a client is violating law, carrier rules, platform policies, or these Terms.

8. Intellectual Property
The website, branding, text, graphics, designs, software configurations, workflows, documentation, and other materials owned by Revenue Regear are protected by intellectual-property laws.
You may not copy, reproduce, distribute, sell, license, reverse engineer, or create derivative works from protected Revenue Regear materials except with written permission or as expressly authorized in a service agreement.

9. Third-Party Services
Our services may use third-party platforms such as CRM providers, telecommunications providers, hosting providers, AI tools, analytics services, payment processors, and integration platforms.
Third-party services are governed by their own terms, policies, pricing, availability, and technical limitations. Revenue Regear does not control and is not responsible for third-party outages, changes, filtering decisions, suspensions, or failures.

10. Communications
When you provide contact information, Revenue Regear may communicate with you regarding your inquiry, appointment, account, requested service, or existing business relationship.
Recurring informational or promotional text messages will be sent only according to the consent and preferences associated with the applicable messaging program.
Marketing SMS consent is not a condition of purchase.

13. Disclaimer
To the maximum extent permitted by law, the website and its content are provided “as is” and “as available.” Revenue Regear disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and noninfringement.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

14. Limitation of Liability
To the maximum extent permitted by law, Revenue Regear will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, lost data, business interruption, loss of goodwill, or damages arising from third-party platforms.
Any limitation that applies to paid services may also be governed by the applicable signed client agreement.
Some jurisdictions do not permit certain limitations, so portions of this section may not apply.

15. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold Revenue Regear harmless from claims, damages, liabilities, penalties, costs, and expenses arising from your unlawful use of the website or services, your messages or contact data, your violation of these Terms, or your infringement of another party’s rights.
This provision should be reviewed and adapted by legal counsel before use in client contracts.

16. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
The venue and dispute-resolution process for paid client services may be stated in the applicable client agreement.

17. Changes
We may update these Terms periodically. The revised Terms will be posted with a new effective date.
